Please read these Terms carefully before using this Site.

1. Overview

These Terms of Service (“Terms”) govern your access to and use of this website (the “Site”) and any training, boarding, protection dog, seminar, academy, or related services (collectively, the “Services”) offered by K9 Defense (“K9 Defense,” “we,” “us,” or “our”), located in Phoenix, Arizona. “You,” “your,” and “user” refer to any visitor to the Site or recipient of the Services.

By accessing the Site or engaging our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site or the Services.

We reserve the right to change or update these Terms at any time, in our sole discretion, by posting the revised Terms on this Site. Your continued use of the Site or Services after any such changes constitutes your acceptance of the revised Terms. You are responsible for reviewing these Terms periodically.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site, book Services, or enter into any agreement with K9 Defense. By using the Site or Services, you represent that you meet this requirement and have the legal authority to enter into these Terms. If you are booking Services on behalf of a household or family dog, you represent that you are the dog’s owner or legal guardian, or are otherwise authorized to make training decisions for the dog.

3. Site Use

You agree to use the Site only for lawful purposes. You agree not to:

• Provide false, inaccurate, or misleading information when contacting us or booking Services;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Post, transmit, or upload any content that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable;
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site, its servers, or any connected network;
• Use any automated system (bots, scrapers, crawlers) to access the Site for any purpose without our prior written consent;
• Violate any applicable local, state, federal, or international law in connection with your use of the Site.

We reserve the right to restrict or terminate your access to the Site at any time, without notice, for any violation of these Terms.

4. Our Services

K9 Defense provides dog training services, including but not limited to obedience training, behavior modification, protection dog training and sales, handler training, working dog programs and law-enforcement-related training, seminars, and public speaking engagements. Service offerings, pricing, and availability are subject to change without notice and may be described in greater detail in a separate service agreement, invoice, or intake form provided to you at booking, which shall control in the event of any conflict with this general Site-wide Terms of Service document.

Nothing on this Site constitutes a guarantee of a specific outcome. Dog training results depend on many factors outside our control, including the individual dog’s temperament, genetics, health, prior history, and the owner’s consistency in applying the training after Services are provided. See Section 8 (“No Guarantee of Results”) below.

5. Purchases, Fees, and Payment

By purchasing Services, submitting payment information, or otherwise enrolling in a program (electronically, verbally, or in writing), you agree to pay all applicable fees as quoted to you at the time of booking. Specific payment schedules, deposit requirements, and program fees for training programs, protection dog placements, boarding/board-and-train programs, and seminars will be set out in your individual service agreement or invoice.

Unless a separate written agreement states otherwise:

• Deposits paid to reserve a training slot, board-and-train program, protection dog, or seminar seat are non-refundable, as they reserve capacity we turn away from other clients.
• Full payment is due according to the schedule provided at booking. We reserve the right to pause or suspend Services for non-payment.
• Late pick-up, extended boarding, or extended program fees may apply and will be disclosed to you in advance where practical.

6. Refund Policy

Except as required by applicable law or expressly stated in a separate written agreement provided to you at the time of purchase, all sales of Services, deposits, and program fees are final and non-refundable once training, boarding, or program services have commenced. We understand that circumstances change, and we will consider refund or credit requests on a case-by-case basis at our sole discretion; making such a consideration in one instance does not obligate us to do so in the future.

7. Assumption of Risk — Dog Training and Handling Services

Please read this section carefully.

Dog training — including obedience training, behavior modification, and especially protection/bite-work training — involves inherent risks, including but not limited to bites, scratches, injury, property damage, and, in rare circumstances, serious injury or death, to you, your dog, other people, and other animals.

By engaging our Services, you acknowledge and agree that:

• You and your dog participate in all training, evaluations, boarding, and related activities at your own risk;
• K9 Defense, its owners, trainers, employees, and contractors (collectively, “K9 Defense Parties”) are not responsible for any injury, illness, death, or property damage arising from or related to your dog’s participation in our Services, except to the extent caused by our gross negligence or willful misconduct;
• You are responsible for disclosing, honestly and completely, your dog’s medical history, behavioral history, and any known bite history or aggression prior to enrollment;
• You are solely responsible for maintaining current vaccinations, flea/parasite control, and general veterinary care for your dog, and will provide proof of vaccination upon request. K9 Defense Parties are not veterinarians and do not provide medical advice; always consult a licensed veterinarian regarding your dog’s health;
• K9 Defense reserves the right, in its sole discretion, to decline, pause, or discontinue Services for any dog it deems to pose an unacceptable risk to people, other animals, or property, without refund of amounts already paid for services rendered.

8. No Guarantee of Results

K9 Defense uses proven, evidence-informed training methods and has extensive experience across working, protection, law enforcement, and pet-dog contexts. However, we do not and cannot guarantee specific training outcomes. Every dog is an individual with a unique temperament, history, and environment, and results depend substantially on factors outside our control, including your consistency in maintaining the training after Services conclude. Any testimonials, before/after descriptions, or examples shared on the Site or in our marketing materials are illustrative only and are not a promise of similar results for your dog.

K9 Defense Parties are not licensed veterinarians, veterinary behaviorists, or medical professionals. Nothing provided through our Services, Site, blog, or social media should be construed as veterinary or medical advice. Always consult a qualified veterinarian for health-related concerns about your dog.

9. Client Responsibilities

You agree to:

• Keep your dog under reasonable control at all times during in-person Services, including using a leash, collar/harness with ID tag, and (if your dog has a bite history or shows aggression) a properly fitted muzzle, as instructed by our trainers;
• Promptly inform us of any change in your dog’s health, behavior, household situation, or legal status relevant to training (for example, a bite incident, quarantine order, or change of ownership);
• Assume responsibility for any injury or damage caused by your dog to people, other animals, or property, except to the extent caused by our gross negligence or willful misconduct;
• Attend scheduled sessions, evaluations, or pickups on time; late arrivals or no-shows may be subject to rescheduling fees or forfeiture of the session at our discretion.

10. Photo, Video, and Testimonial Consent

Group classes, seminars, evaluations, and training sessions may be photographed or recorded for training, quality assurance, marketing, and educational purposes, including use on our website, blog, and social media accounts. By participating in our Services, you consent to such recording and to K9 Defense’s use, reproduction, and distribution of resulting photos, videos, and testimonials, unless you notify us in writing in advance that you do not consent. If you do not wish to be photographed or recorded, please notify us prior to your session so we can accommodate your request where reasonably possible. You may withdraw your consent for future marketing use by contacting us in writing.

11. Intellectual Property

The Site and all content on it — including text, graphics, photographs, videos, logos, the K9 Defense name and marks, and the selection and arrangement of that content (collectively, “Content”) — is owned by or licensed to K9 Defense and is protected by U.S. copyright, trademark, and other intellectual property laws.

You may view, print, or download a single electronic or printed copy of Content for your personal, non-commercial use only, provided you retain all copyright and proprietary notices. You may not modify, reproduce, republish, distribute, publicly display or perform, create derivative works from, or otherwise commercially exploit any Content without our prior written consent. Unauthorized use of our Content may result in civil or criminal liability.

12. Third-Party Links and Content

The Site may contain links to third-party websites, social media platforms, payment processors, or booking/scheduling tools that are not owned or controlled by K9 Defense. We do not endorse and are not responsible for the content, accuracy, policies, or practices of any third-party site or service. Your use of any third-party site is at your own risk and subject to that third party’s own terms and privacy policy.

13. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Site is at your own risk.

14. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall K9 Defense Parties be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of the Site or Services, including without limitation loss of data, revenue, or goodwill, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, K9 Defense Parties’ total cumulative liability to you for any claim arising out of or related to the Site or Services shall not exceed the total amount you paid to K9 Defense for the Services giving rise to the claim in the six (6) months preceding the claim.

Some states do not allow the exclusion or limitation of certain damages or warranties; in such states, our liability is limited to the fullest extent permitted by law. Nothing in these Terms is intended to limit liability that cannot lawfully be limited, including liability for gross negligence, willful misconduct, or other liability that Arizona law does not permit parties to waive or limit by contract.

15. Indemnification

You agree to indemnify, defend, and hold harmless K9 Defense Parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your use of the Site or Services; (c) your dog’s conduct during or after Services; or (d) your violation of any law or the rights of a third party.

16. Release of Claims

To the fullest extent permitted by law, you release K9 Defense Parties from any and all claims, known or unknown, arising from your use of the Site, participation in our Services, or your dog’s participation in training, evaluations, or boarding — except for claims arising from our gross negligence or willful misconduct.

17. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site or Services, you agree to the practices described in our Privacy Policy.

18. Children’s Privacy

This Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site. If we learn we have inadvertently collected such information, we will delete it.

19. Governing Law and Dispute Resolution

These Terms are governed by and shall be interpreted under the laws of the State of Arizona, without regard to its conflict-of-laws principles.

Before initiating any formal legal action, you agree to first contact us and attempt to resolve any dispute informally by providing written notice describing the dispute and the relief sought. Absent a separate written arbitration agreement between the parties, you agree that any dispute shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

20. Severability

If any provision of these Terms is held invalid or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision. No waiver will be effective unless in writing and signed by an authorized representative of K9 Defense.

22. Assignment

These Terms are binding on and inure to the benefit of the parties and their respective successors and permitted assigns. You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms at any time without notice to you.

23. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreement or invoice provided to you at booking, constitute the entire agreement between you and K9 Defense regarding the Site and Services, and supersede any prior agreements or understandings, written or oral.
